 Krasnoyarsk Territory Arbitrage confirmed the decision of the regional directorate of Federal Inspectorate for Consumer Rights' Protection and People's Health (Rospotrebnadzor) that actions of Eldorado-Krasnoyarsk Ltd can be classified as administrative violation "Consumer fraud". That was reported by Alexander Gurskiy, the judge of the administrative board, the chairman of the sixth judicial group of the Arbitrage.
According to him, Eldorado-Krasnoyarsk Ltd appealed to the Arbitrage claiming to find the regulation passed by Rospotrebnadzor on article 14 of the Administrative Code "Consumer fraud" illegal.
It follows from the claim files that Production and Construction Company Eldorado-Krasnoyarsk Ltd had been imposed a penalty of $350 by Rospotrebnadzor for consumer fraud on after a checkup. It was said in the report that consumer Urtsegova had been misled by shop assistants of Eldorado-Krasnoyarsk Ltd when she was buying a computer for $470 on April, 24, 2006. She was offered buying a 2 years' warranty service certificate, $60 in sum, thus being deceived about the volume, character and term of warranty service. As a result, the customer signed a contract about extra warranty service, $60 in sum, and received a 2 years' warranty service certificate.
According to the contract, the product bought is due to be substituted and mended for two years after the purchase. The warranty service for the computer bought by Urtsegova was three years, according to the warranty service provided by the manufacturer. So the extra warranty service certificate was illegal, as any product must be substituted or repaired on the basis of warranty duties of the shop. Nevertheless, having convinced the customer of the necessity to buy the extra certificate, the shop made her pay for two years' service.
The Arbitrage rejected Eldorado-Krasnoyarsk's claim, leaving the decision of Rospotrebnadzor legal, on October, 12.
Alexander Gurskiy noted that the Arbitrage Court had considered several similar claims sent by Eldorado-Krasnoyarsk Ltd to the directorate for Rospotrebnadzor.
